He’d meticulously drafted a codicil to his Living Trust, intending to add a rental property he’d acquired, but never actually funded the trust with the deed. Vincent passed away unexpectedly a week later, and now his family faces a costly probate battle over that single property. It’s a tragically common scenario – a beautiful estate plan on paper, rendered useless by a simple oversight. The potential cost? Easily $35,000 in legal fees and executor commissions, not to mention the emotional toll on his grieving children.
What Happens if I Forget to Transfer My Escondido Property into My Trust?

As an Estate Planning Attorney and CPA with over 35 years of experience here in Escondido, I’ve seen this mistake countless times. The trust document itself is just the starting point. Under California Probate Code § 15200, a trust is not valid unless it holds identifiable property; signing the trust document is only step one—you must legally transfer assets (funding) to the trustee for the trust to exist. If you die with real estate still in your name, even if a trust exists, that property will likely require a court-supervised probate proceeding. That defeats the entire purpose of creating a trust – avoiding probate!
Can I Still Correct a Missed Property After My Passing?
Sometimes, yes. For deaths occurring on or after April 1, 2025, Assembly Bill 2016 (AB 2016) significantly simplifies this process. If a primary residence intended for the trust was accidentally left out, and its value doesn’t exceed $750,000, your heirs can utilize a ‘Petition for Succession’ under Probate Code § 13151. It’s a streamlined process, but it requires court approval. This is fundamentally different than the older Small Estate Affidavit process which had lower limits and more restrictions. We always advise clients to think of this as a ‘safety net,’ not a planned workaround.
What About Prop 19 and Gifting Real Estate Through My Trust?
Many of my clients are concerned about Proposition 19. While transferring your home into your revocable trust does not trigger reassessment, the eventual distribution to your children will trigger a Prop 19 reassessment to current market value unless the child moves in as their primary residence within one year. Life changes – marriages, divorces, births, acquisitions – all necessitate a review of your estate plan. We routinely assist clients with trust amendments to reflect their evolving circumstances.
What About Digital Assets and LLCs?
Modern estate planning extends beyond tangible assets. Without specific RUFADAA language (Probate Code § 870) in your trust, service providers like Apple, Google, and Coinbase can legally deny your successor trustee access to your digital photos, emails, and cryptocurrency. Furthermore, as of March 2025, domestic U.S. LLCs held in a living trust are exempt from mandatory BOI reporting; however, trustees managing foreign-registered entities must still file updates with FinCEN within 30 days.
What about Estate Taxes?
Effective Jan 1, 2026, the OBBBA permanently set the Federal Estate Tax Exemption to $15 million per person, meaning the primary focus of most Living Trusts is now avoiding probate and protecting privacy, rather than minimizing federal taxes.
How do California trustee duties and funding rules shape the outcome for beneficiaries?
The advantage of a California trust is control and continuity, but this relies entirely on accurate funding and disciplined administration. Without clear asset titles and strict adherence to fiduciary standards, a private trust can quickly become a subject of public litigation over mismanagement, capacity, or undue influence.
To ensure the plan actually works, you must move assets correctly using trust funding procedures, and ensure all players understand their roles by identifying the who is involved in a trust to prevent confusion when authority transfers.
Ultimately, the success of a trust depends on the details—proper funding, clear terms, and a trustee willing to follow the rules. By anticipating friction points and documenting every step of the administration, fiduciaries can protect the estate and themselves from liability.
